Historic ICC Complaint Filed Against US Leadership Over Afghanistan Exit
In a groundbreaking legal move, Afghan citizens, led by Baryalai Nasrati, leader of Afghanistan’s Third National Way Movement, have filed a complaint with the International Criminal Court (ICC) against President Joe Biden, Vice President Kamala Harris, and their advisors on December 3, 2024.
The complaint centers on the US forces’ withdrawal from Afghanistan, which led to the collapse of the democratic government and the Taliban group’s return to power. The petitioners argue that the unilateral withdrawal by August 31, 2021, violated strategic partnership agreements and bilateral security commitments.
The filing highlights severe consequences, including humanitarian crisis affecting 28.3 million people, systematic elimination of women’s rights, and economic collapse following the freezing of $9.5 billion in foreign reserves. The complaint seeks investigation and accountability for alleged violations of international humanitarian law.
