These Terms of Use (“Terms”) are an agreement between you and Zarin TV LLC (“Zarin TV”, “we”, “us” or “our”). They apply when you use:

  • Our website: zarintv.com, including its English, Dari and Pashto sections, and live.zarintv.com (the “Website”).
  • Our apps: the Zarin TV apps, including the Zarin TV channel on Roku, the Zarin TV iPhone app, and any other Zarin TV app that links to these Terms (the “Apps”).

Together, these are our “Services”. Our Privacy Policy explains how we handle information: https://zarintv.com/privacy-policy

1. Accepting these Terms

By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. The Services

  • Zarin TV is an independent, internet-only Afghan television channel based in the United States. We stream 24 hours a day in Dari (Persian), Pashto and English.
  • Watching Zarin TV on our Services is free, with no account or sign-in. The Roku app has no in-app purchases and does not insert ads.
  • The live player on our Website and inside our iPhone app may show video ads from third-party ad partners, as described in our Privacy Policy.
  • The Services are provided “as is” and “as available”. Availability, picture quality and features may vary by country or region, device, app store and internet connection.
  • We may change, pause or stop any part of the Services at any time.

3. Acceptable use

You may use the Services only for your own personal, non-commercial viewing. You agree not to:

  • re-broadcast, re-stream, record, copy or distribute our stream or programmes, or show them in a public or commercial place, without our written permission;
  • present our stream as if it comes from someone else;
  • get around any technical protection, geographic limit or access control in the Services;
  • interfere with or disrupt the Services, our servers or networks (for example by hacking, scraping or overloading them);
  • use the Services in a way that breaks any law or the rights of others.

You are responsible for any comment you post on the Website; it must not be unlawful, abusive or infringing, and we may remove it. We may block access for anyone who breaks these Terms.

4. Intellectual property

  • Zarin TV’s programmes, the Zarin TV name and logo, and our trademarks, graphics and other content are owned by Zarin TV or licensed to us, and are protected by copyright and trademark laws.
  • Third-party content, such as programmes, clips, music, news footage and trademarks, belongs to its owners.
  • These Terms give you no right to use our content or trademarks beyond personal viewing. To ask for permission, email [email protected].

5. Copyright complaints

If you believe that content on our Services infringes your copyright, please send a written notice to [email protected], or by post to the address in section 12. Please include:

  1. your physical or electronic signature, as the copyright owner or a person authorized to act for the owner;
  2. a description of the copyrighted work you believe has been infringed;
  3. a description of the material you believe is infringing, and where it appears (for example, a web address, or the programme name, date and approximate time of broadcast);
  4. your name, postal address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner.

We will review each complete notice and may remove or disable access to the material.

6. Third-party platforms, ads and links

  • App stores and devices. If you use our Apps on Roku, Apple, Google or Amazon devices or app stores, their own terms and policies also apply. Those companies are not parties to these Terms and are not responsible for our Apps or content. Apple and its subsidiaries are third-party beneficiaries of these Terms for the Zarin TV iPhone app and may enforce them against you.
  • Other services. You can also watch Zarin TV on services run by other companies, such as GlWiz, Afghan ProCast TV and the Eshgh TV box. Their own terms apply when you use them.
  • Ads and links. Ads shown by our third-party ad partners, and links to other websites or apps, are not controlled by Zarin TV. We do not endorse them and are not responsible for their content, products or practices.

7. News and opinion content

  • Our programmes include news, discussion and opinion. We work to be accurate, but we cannot guarantee that all content is complete, correct or up to date.
  • Views expressed by guests, presenters, callers and commentators are their own and do not necessarily reflect the views of Zarin TV.
  • Our content is general information, not professional advice.

8. Disclaimer of warranties

To the fullest extent the law allows, the Services and all content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Services will be uninterrupted, error-free or secure, or available in your region or on your device.

9. Limitation of liability

To the fullest extent the law allows:

  • Zarin TV and its owners, staff, partners and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of, or inability to use, the Services.
  • Our total liability for any claim related to the Services is limited to US$100.

Some places do not allow these exclusions or limits, so parts of sections 8 and 9 may not apply to you. Nothing in these Terms limits rights that cannot be waived by law.

10. Changes to these Terms

  • We may update these Terms from time to time. We will post changes on this page and update the “Last updated” date at the top.
  • For significant changes, we will also show a notice on the Website and, where possible, in the Apps.
  • If you keep using the Services after changes take effect, you accept the updated Terms.

11. Governing law and general terms

  • These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules.
  • Any dispute related to these Terms or the Services will be heard in the state or federal courts located in California, unless the law where you live gives you the right to bring a claim in your local courts.
  • If any part of these Terms cannot be enforced, the rest stays in effect. Not enforcing a part of these Terms does not waive our right to enforce it later.
