Judges of the ICC's Pre-Trial Chamber II have asked prosecutors to consider opening a separate investigation into Taliban gender-based persecution. The decision was issued in mid-July 2026 by a three-judge panel.

Judges noted that Taliban actions since their return to power in August 2021 differ "fundamentally" from conflict-related violence covered by existing investigations. The new charges relate mainly to policies and restrictions imposed on women and girls.

The ICC had previously issued arrest warrants for Taliban leader Hibatullah Akhundzada and Supreme Court chief Abdul Hakim Haqqani. The prosecutor's office has not yet announced a final decision on launching a separate probe.
