British SAS forces accused of war crimes in Afghanistan have filed for judicial review against Judge Lord Haddon-Cave who limited their presence in investigative hearings with whistleblower testimony.
The soldiers accused the judge of violating law and the principle of transparent justice by restricting their participation in the proceedings.
Judge Lord Haddon-Cave heads the “Afghanistan Independent Inquiry” investigating claims of execution of at least 80 Afghan civilians by SAS forces between 2010 and 2013.
The Ministry of Defense’s legal team filed the judicial review request on behalf of the soldiers, demanding adherence to “strict standards of justice” for both soldiers and victims’ families.
The SAS investigation has been ongoing in London’s High Court for two years, and this judicial review request may temporarily halt proceedings.
The British Ministry of Defense emphasized that these forces “fought bravely worldwide” and recognizes their right to initiate judicial review.
